There is no retainer, no contract and no minimum.

1. About AccuraLead

accuralead.com is operated by AccuraLead LLC, a Florida limited liability company. AccuraLead is a marketing and lead generation company. It does not originate loans, issue credit decisions, underwrite, provide financial advice, or act as a mortgage broker, lender or settlement service provider.

Fees are charged for the delivery of a marketing file. No fee charged by AccuraLead is contingent on a loan application, a loan closing, a loan funding, or a property sale, and no portion of any fee is paid or received in exchange for the referral of settlement service business.

2. Acceptance

By using this site, submitting the fit quiz, booking a call, or purchasing a file, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the site. We may update these Terms; continued use after an update constitutes acceptance, and material changes will be emailed to active clients.

3. Eligibility

By purchasing files you represent that you are:

You are responsible for maintaining your own licensing and for your own compliance with the laws that govern your profession. We do not verify your licensing and do not provide legal or compliance advice.

4. What a file is

A file is a record of one homebuyer who found us through search, completed our intake, and spoke with a person on the phone before the file was created. A file contains the buyer’s contact details, the criteria they stated on that call, and the loan programs they matched to.

When delivery occurs. Except as stated in Section 7A for Live Transfers, a file is delivered at the moment the buyer’s introduction call is confirmed on your calendar, together with notification of the file contents. That moment starts the seven-day dispute window in Section 7 and is the point at which the fee for that file is fully earned. Our booking and notification record is the authoritative record of delivery and its timestamp.

A file is a marketing asset. It is not a pre-approval, a pre-qualification, an underwriting determination, or a representation that any buyer will qualify for financing, respond to you, or transact. Credit information in a file is self-reported by the buyer. We do not pull credit.

5. Pricing and payment

5A. Payment reversals

You agree not to initiate a chargeback, ACH return, payment reversal or bank dispute for any amount paid to AccuraLead. Every payment question and every file dispute is handled through Section 7 of these Terms.

Initiating a reversal is a material breach. Where a reversal is initiated, you remain liable for the original amount plus any fee charged to us by the payment processor or bank, plus a $50 administrative fee. We may suspend delivery immediately and terminate your account for cause, and unused balance is forfeited to the extent of amounts reversed.

6. Exclusivity

Every file is delivered to one mortgage professional only and is never resold, syndicated or redistributed to a competing mortgage professional. Where the buyer is not already working with a real estate agent and asks us for one, the file may also be delivered to a single licensed real estate agent in that town. A lender and an agent are not competitors. Agent territory, where offered, is exclusive at the town level.

In exchange, you agree not to resell, share, syndicate or redistribute any file, in whole or in part, to any third party. Exclusivity protects both sides and is a material term of these Terms.

6A. Non-circumvention

For ninety (90) days after delivery, Client will not refer, introduce or route the buyer to any other service provider in connection with the transaction, including a mortgage broker, lender or loan originator, a real estate agent or brokerage, an insurance producer, a credit repair provider, or a title or settlement company, and will not accept compensation, referral fees or consideration of any kind for doing so. If the buyer asks Client for such a referral, Client will notify AccuraLead and AccuraLead will make the introduction.

7. Replacement policy

You have seven days from delivery to dispute a file. Valid grounds for replacement:

Valid disputes are replaced, not refunded. The following are not grounds for replacement, because they are the ordinary work of selling:

7A. Live Transfers

A Live Transfer is billable only when Client answers and the call remains connected for at least sixty (60) seconds after AccuraLead introduces the buyer. AccuraLead stays on the line through the introduction, then drops. A call that does not reach sixty (60) seconds connected, including no answer, a dropped call, loss of signal, or carrier failure, is not billable and does not draw against Client’s balance. Once the sixty-second threshold is met, the Live Transfer is delivered and the fee is earned. Live Transfers are not subject to the replacement grounds in §7, which describe defects in file contact data and do not apply to a call that connected.

7B. Booked appointments

A file is delivered when the buyer is booked on Client’s calendar. If the buyer does not attend, AccuraLead will attempt one re-engagement at no charge, and will replace the file if the buyer will not rebook. A missed appointment does not qualify for replacement where Client failed to attend, joined late, or rescheduled. Reschedules must be made through the AccuraLead scheduling link. AccuraLead’s delivery and confirmation records govern disputes, which must be raised within the seven (7) day window in §7.

8. No guarantee of outcome

We make no representation that any file will convert, that any buyer will answer, or that you will fund any loan. Figures shown in our calculator, on our site, or in any conversation are estimates for illustration only, based on inputs you choose, and are not a projection or promise of earnings.

9. Your obligations with buyer data

When a file is delivered to you, you become an independent controller of that buyer’s personal information. You agree to contact the buyer only about the financing enquiry they made, to honor any opt-out they give you, to keep the data secure, and to comply with the Telephone Consumer Protection Act, CAN-SPAM, applicable state privacy law and any licensing rules that apply to you.

10. Intellectual property

The AccuraLead name, logo, site design, screening methodology and written content are the property of AccuraLead LLC. Purchasing a file grants you a limited, non-transferable right to use that file’s contents for your own origination or representation activity. It grants no other license.

11. Acceptable use

You may not scrape, crawl or bulk-download the site, attempt to access systems or data you are not authorized to access, misrepresent your identity or licensing, or use the site to send unlawful communications.

12. Disclaimer of warranties

The site and the files are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted or error-free.

13. Limitation of liability

To the maximum extent permitted by law, AccuraLead LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost commissions or lost business opportunity, arising from your use of the site or any file. Our total aggregate liability for any claim is limited to the amount you paid us for the file or files giving rise to that claim.

14. Indemnification

You agree to indemnify and hold harmless AccuraLead LLC and its members from claims, damages and reasonable legal fees arising from your use of a file, your communications with any buyer, your breach of these Terms, or your violation of any law or licensing requirement applicable to you.

14A. Assignment

Client may not assign an order, a balance, or any file license without AccuraLead’s written consent. A file license is granted to the Client entity named on the order. It does not travel with a departing originator and does not transfer to an acquiring entity without written consent.

15. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Subject to Section 15A, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Pinellas County, Florida, and both parties consent to that jurisdiction.

15A. Binding arbitration

Read this section carefully. It affects how disputes between us are resolved.

Informal resolution first. Before starting arbitration, you agree to email karl@accuralead.com with a written description of the dispute and the relief you seek, and to allow thirty (30) days for good-faith resolution. This is a condition precedent to arbitration.

Arbitration. Any dispute arising out of or relating to these Terms, any file, or the relationship between us that is not resolved informally will be settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Judgment on the award may be entered in any court of competent jurisdiction.

Seat. Arbitration will be seated in Pinellas County, Florida. Either party may appear remotely.

Class action waiver. You and AccuraLead each waive any right to bring or participate in a class, collective, consolidated or representative action. The arbitrator may award relief only to the individual party seeking relief, and only to the extent necessary to provide relief warranted by that party’s individual claim. If this class waiver is found unenforceable as to a particular claim, that claim proceeds in court and is severed from arbitration; the remainder of this Section stays in force.

Small claims carve-out. Either party may bring an individual claim in small claims court instead of arbitration.

Costs. Each party bears its own attorneys’ fees and costs unless the arbitrator awards otherwise under applicable law.
